Copyright Violation in Action: The Case of the Paul Kopeikin Gallery


Response from AIPAD

What follows is a response from Robert Klein, President of the Association of International Photography Art Dealers (AIPAD), on behalf of the AIPAD board, to the charges I lodged in August 2001 with that organization against one of its members, Paul Kopeikin.

The "'alert' memo concerning copyright and Internet issues" that Klein promises below apparently did go out to the AIPAD membership in October 2001. After repeated formal requests, I finally received a copy (mailed to me on February 13, 2003). No "symposium for [AIPAD] members so that these issues can be explored in depth" has taken place, none has been scheduled for the future, and plans for any -- if ever seriously considered -- appear to have been abandoned.

Dear Allan,

AIPAD has received a complaint from you asserting that one of our members is in violation of copyright laws. After lengthy discussions throughout the latter part of the summer and as a direct result of a decision that was reached at AIPAD's October board meeting I am charged with offering you the following:

The Board of Directors of AIPAD has asked me to extend to you its thanks for making us aware of the matter between you and Paul Kopeikin and, simultaneously, calling our attention to copyright issues involving intellectual property on the Internet that may effect [sic] our members.

At its recent meeting the Board thoroughly discussed the issues you have raised. We are drafting a letter stating our position on the Kopeikin matter and sending it to him shortly. The contents of this letter we consider an internal AIPAD matter and they will remain confidential.

Additionally, we are drafting an "alert" memo concerning the copyright and Internet issues you have raised that will go out to our membership. I will make sure you are sent a copy.

Further, as you and I discussed earlier, we are attempting to organize some sort of symposium for our members so that these issues can be explored in depth.
